Who Can Apply
Portugal's parental leave framework is largely non-discriminatory by nationality — what matters is your employment and social security contribution status. The **Portuguese Labor Code **(Código do Trabalho) applies to all workers in Portugal regardless of nationality.
- Employed migrants with at least 6 months of social security contributions are entitled to the full parental allowance (subsídio parental).
- Refugees and beneficiaries of subsidiary protection are entitled to the same social welfare rights — including parental benefits — under the same conditions as Portuguese nationals.
- Migrants not working or without sufficient contributions, as well as stateless persons, can access the Social Parental Allowance (subsídio social parental) as a safety net.
The Standard Parental Leave Framework
Detailed information from GOV.PT
Portugal does not have separate "maternity" and "paternity" leave per se — the system is unified under licença parental (parental leave), which applies equally to all qualifying parents.
Initial Parental Leave
- 120 days paid at 100% of the reference salary, or 150 days paid at 80%
- The leave can be shared between both parents or taken by one parent
- A parliament-approved proposal for 180 days at 100% pay has been advancing as of early 2026, potentially starting in 2027
Mandatory Periods
- Mothers must take 42 days immediately after birth
- Fathers must take 28 mandatory days, with the first 7 taken immediately after birth, plus an optional extra 7 days
- Fathers' mandatory leave must overlap with the mother's 42-day mandatory period
Extended Parental Leave
Either parent can take up to 3 additional months of unpaid leave after the initial period.
The Social Parental Allowance (Safety Net for Migrants)
This is the key benefit for migrants who are not employed, undocumented, or have insufficient contributions. The Portuguese Social Security explicitly lists eligibility as: "national and foreign citizens, refugees and stateless persons not covered by any compulsory social protection scheme."
Eligibility conditions:
- Must reside in Portuguese territory
- Household assets must not exceed €122,222.40 (240× the Social Support Index)
- Monthly household income per capita must not exceed €407.40 (80% of the SSI)
Refugees & Asylum Seekers
Recognised refugees and those with subsidiary protection status receive full parity with Portuguese nationals — their rights include parental benefits, family allowances, and child benefits. UNHCR Portugal confirms: "work, education, social welfare and medical care under the same terms and conditions as Portuguese citizens".
Asylum seekers (pending recognition) have a more limited scope during the application period. However, once status is granted, they gain access to the full social welfare. More information: from UNHCR.
Key Qualifying Conditions for the Standard Allowance
To access the full parental allowance (not just the social safety-net version), any parent — migrant or otherwise — must meet the following criteria:
- Be registered and contributing to Portuguese Social Security for at least 6 calendar months
- For the self-employed: contributions must be paid up to the end of the 3rd month before stopping work due to childbirth
- Submit a claim within 6 months of the first day of leave — late claims reduce the benefit period
